A 25-year-old man facing first-degree rape and burglary charges made a preliminary appearance in Yakima County Superior Court Monday.

Yakima County Sheriff’s deputies arrested the man at about 2:25 a.m. Monday after finding him at the victim’s apartment in the 600 block of Juniper Street in Toppenish.

According to a probable cause affidavit by deputies, the victim was asleep with her 2-month-old baby when the man entered her apartment.

She awoke to find him standing over her bed; he put a pacifier in the baby’s mouth and began undressing the woman, the affidavit said.

The man slapped the women several times, said her boyfriend owed him money and threatened to harm her baby if she continued to resist, the affidavit said.

After the man finished raping her, he went into the kitchen and she called police, the affidavit said.

When deputies arrived, the man told the woman to say they were in relationship or he’d come back and harm her and her baby.

Deputies arrested the man after the woman said she’d been raped. Deputies found jewelry and two cellphones in the man’s possession that belonged to the woman, the affidavit said.
