NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Yakama Nation Housing Authority.
REQUEST FOR RELEASE OF FUNDS
On or about October 8, 2020 the Confederated Tribes and Bands of the Yakama Nation (the “Tribe”)will authorize the Yakama Nation Housing Authority (the “Authority”) to submit a request to the United States Department of Housing and Urban Development (“HUD”) for the release of Indian Housing Block Grant Funds under the Native American Housing and Self Determination Act of 1996, as amended (the Grant), to undertake a project known as the YNHA Wishram Gorge View Estates (The “Project”) for the purpose of constructing 46 Single family homes (residential property) to fulfill the need for housing and to assist in the prevention of the novel Coronavirus; and for the construction of a Community Center on approximately 18 acres of partially developed property in Wishram, WA. The Project will cost approximately $ 17,000,227 to complete. The project will also make moderate improvements to existing roads as necessary.
FINDING OF NO SIGNIFICANT IMPACT
The Tribe has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the offices of the Yakama Nation Housing Authority at 611 South Camas Avenue, Wapato, WA for review and in consideration of public safety an electronic version may be downloaded from the Yakama Nation Housing Authority website at the following address: https://www.ynha.org/public-documents/
Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments safely to the Yakama Nation Housing Authority via email at firstname.lastname@example.org. All comments received by October 26, 2020 will be considered by the Tribe. Comments should specify which notice they are addressing.
RELEASE OF FUNDS
The Tribe certifies to HUD that Mr. Delano Saluskin, in his capacity as Chairman, Yakama Tribal Council consents to accept the Jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Authority to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of funds and the Tribe’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are one of the following bases: (a) the certification was not executed by the Certifying Officer of the Tribe; (b) the Tribe has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred cost not authorized by 24 CFR Part 58 before approval of a release of funds by HUD: or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to HUD at Northwest Office of Native American Programs, 909 1st Avenue, Suite 300, Seattle, WA 98104-1000, in consideration of public safety, comments should be e-mailed to HUD ONAP Regional Administrator Tom Carney at email@example.com. Potential objectors should contact HUD to verify the actual last day of the objection period.
